To me, that means he's still Sporting's player as they've not been granted a transfer certificate meaning the transfer doesn't count

Just because he's not registered to play for us doesn't mean he's not the club's employee. He's signed a contract to play for us. We signed a contract to buy him from Sporting. Registering him as a player is not the same thing.


You would think that there would be something in the contract with Sporting to say that the sale was subject to international clearance. But if there wasn't, there's not much we can do about it.

This is from the merc website - statement made by LCFC on September 1st.

"Leicester City can confirm that terms have been agreed with Sporting Clube de Portugal for the transfer of midfielder Adrien Silva," it read. "The transfer remains subject to international clearance approval."
 
From the wording of Sky's article is appears the transfer is off completely.

Not that it should be but I'm doubting we will ever see him play for us.

The Club is therefore unable to complete the registration of Adrien’s transfer from Sporting. As a result, he will be ineligible for selection until January, when the transfer window – and its associated registration period – re-opens.

A Leicester City spokesman said: “We cannot hide our disappointment or that of the player at the short-term consequences of the decision.

“We maintain, and have made strong representations to FIFA’s Players’ Status Committee, that all parties involved in Adrien’s transfer fulfilled their obligations, consistent with FIFA regulations and within the required timeframe. The Club is reserving its position in relation to whether it will decide to appeal the decision to the Court of Arbitration for Sport.

“The Club and its staff will continue to work with Adrien to hopefully minimise the impact that missing a substantial period of the season may have on the player, while continuing to prepare the squad for the games ahead.”

Wow, that's a strongly worded statement. They obviously feel aggrieved. Taking it to CAS would be I guess the only route open for them to contest the decision and to do so suggests they are confident of having done no wrong.

What impresses me most about the statement is the solidarity it shows with Silva. There's no suggestion that they consider him anything other than a Leicester player.

Or it is a thinly veiled suggestion that LCFC sent the transfer forms on time, but the FA did not send their International Clearance form on time?

Why else would the appeal have been from the FA rather than the Club?

Leicester City Adrien Silva opinion: Time for City to challenge FIFA


Leicester City are weighing up whether to take FIFA to the Court of Arbitration in Sport over the Adrien Silva situation - it might be beneficial to all concerned if they do.

It might not ensure Silva is able to play football again before January 1. It seems ridiculous that a player who has committed no crime has to lose four months of his short career through no fault of his own.

However, it could bring some clarity to what has been a mystifying period for City fans and football in general.

FIFA insist that rules are rules and that the documentation RECIEVED by the FA to complete Silva’s transfer from Sporting Lisbon was received 14 seconds after the deadline.

It was their stance after the deadline closed and a single judge of FIFA’s own Players’ Status Committee has upheld that ruling despite City submitting evidence they believe was irrefutable in their favour.

City have identified in FIFA’s own wording of their transfer regulations that the documentation had to be UPLOADED before the deadline.

They have spent almost a month gathering forensic computer evidence that they have adhered to that wording in the regulations.

FIFA will not relent, probably irritated that City may have found some loophole in their regulations, or stubborn in their insistence they cannot be wrong. They run world football after all. They are not to be challenged.

It is time they were.

The Court of Sporting Arbitration can deliberate for lengthy spells on sporting matters. That is widely recognised, so an appeal to them may not mean Silva can be registered before January 1, which is the date he currently will get the clearance to ply his trade once more.

Such a legal challenge may not change the situation, but the fact an independent body could examine the evidence and give an impartial ruling would be significant.

It is likely that after this case FIFA will move swiftly to close such a loophole.

It would be embarrassing for them and set a precedent if CAS ruled in City’s favour, especially if the evidence was indeed overwhelming despite their own ‘Judge’ dismissing it.

City are currently paying Silva’s wages and he is expected to be amongst City’s highest earners. He is a Portugal international and European Championship winner after all, and yet they are denied his services by this ruling. Compensation could be significant if a case was proven.

At least now the player can actually train with his new team-mates.

Ambiguity over his registration status prevented him from training with City. Was he legally City’s player or Sporting’s? City couldn’t take the risk of him getting injured if he wasn’t their man. This was a unique situation so caution was the best course of action.

Whatever City decide to do, at the heart of it will be Silva.

They have wanted the player for a long time. They see him as a long-term contributor in City’s development.

Okay, there will be many who won’t have much sympathy for a rich footballer being paid thousands of pounds for doing very little, but I can’t help but feel sorry for him.

Worst still, it is a World Cup year and he has been left out of the recent Portugal squad as a result of the situation. He will be playing catch up to get back to full fitness and sharpness midway through a season when everyone else is up and running at full throttle.

He is an experienced player who has been relishing playing in the Premier League for some time.

Today’s ruling means he will have to wait even longer, and that may not change even if City do go to CAS.

But it might make FIFA have a rethink, and challenging authority is never be a bad thing.
