There's nothing to suggest that DJ or anybody else has been charged. The 'sub-judice' rules don't come in until a charge has been made. That doesn't mean that the normal restraints relating to libel and slander can be ignored though.
In most criminal cases, the "active" period starts with the granting of an arrest warrant, the arrest of a suspect, or the issue of a summons or indictment. This may be well before a person is charged.
