Annoyed! I have to go to a disciplinary meeting tomorrow because I failed to disclose a 20yr old motoring offence as a criminal conviction on my CRB and application form, and have been accused of deliberately falsifying information to get the job. FFS :098:

It is a general rule that a 20 year old motoring offence is a spent conviction unless you were sent to prison for 2½ years or more - you do not have to declare it in a job application. There are exceptions however in the case of certain listed occupations where even a spent conviction should be declared. Is the job in this list?

Accountants
Chiropractor
Dealer in securities
Dentists, dental hygienist or dental auxiliary
Director, controller, etc. of insurance company or building society
Firearms dealers
Judicial appointments
Justices' Chief Executives, Justices' Clerks and assistants
Nurses and midwives
Opticians
Osteopath
Pharmaceutical chemists
Police constables
Prison board of visitors
Prison officers
Probation officers
Teachers
Traffic wardens
Lawyers Veterinary surgeons
Manager or trustees of unit trust Medical practitioners

Other excepted occupations include:

• Any office or employment where the question about spent convictions is asked for the purpose of safeguarding national security - for example, if you wish to be employed by the UK Atomic Energy Authority, the Civil Aviation Authority or as an officer of the Crown.

• Certain types of work in health and social services where the work involves access to people over 65, people suffering from serious illness or mental disorder, alcoholics or drug addicts, blind, deaf or dumb people, persons who are substantially and permanently handicapped by illness, injury or congenital deformity, or where the work is concerned with the provision of care, recreation or leisure facilities, schooling, social services, supervision or training, to people under 18.

In my long experience of employing people to work with people under 18, I can honestly say that motoring convictions 20 years ago were ignored unless there was another reason not to ignore them. Even drink-drive offences were ignored after 10 years in the absence of other doubts.

Did the application form make it clear that spent convictions had to be disclosed and give the reason why?

Do you think this is genuinely the reason why you are facing a disciplinary hearing? Have you asked your union for advice? Will you be represented at the hearing?

I reckon it's more than likely that Trevor has been found out (I believe it was a work colleague he was knobbing) and now SJN is needed as a character witness

The job is in a secondary school. I have spent 11 years working in schools and have now undergone 5 different checks and never had this problem before. They are saying that I deliberately falsified information by not disclosing criminal convictions on my application for or at the interview.

I wasn't aware that motoring offences were criminal convictions, but it seems that an offence of driving without insurance back in 1986 has shown up and it is for this that I have to attend an interview in order that they can decide whether their is enough evidence to issue formal disciplinary proceedings.

The application only asked for criminal convictions.

Seems a bit like a steamhammer to crack a nut, but there we are, I have to go along this afternoon and see what they say.

I don't plan to be represented at this stage as my union membership lapsed following my redundancy back in August

I have filled out similar forms but not for working with kids. My form clearly stated that motoring offences, even speeding fines were classed as convictions.
