Surely for it to be thrown out, an arrest needs to be made or charges brought?

The police make plenty of arrests which are thrown out, the average copper has a passing knowledge of the arrest powers and less idea about the law than a spaniel.

You generally won't be arrested for it because officers know it's a sure fire way to screw a career, even the thickest copper knows this.

To be clear, I wasn't making any argument. I was responding to the argument that they would be arrested, as if it was a given that it is against the law to cuss in the street
