I would believe someone never being fit enough to carry out his job, whatever that job is would be a reason to terminate his contract. i.e the eating too many crisps senario.

However it is likely that it would go to an employment tribunal. I would like to think that lcfc have taken professional advice on this and maybe dont fanct their chances much? We end up paying more in costs etc that way.

I beleive that someone at the club, either CL or the physios or the club doc must believe that he can be fit once again to play for us (even if the fans dont) or else surely they would have to at least talk to him about terminating his contract.

The standard contract, approved by the PFA, provides that a player can not have his contract terminated simply on account of his 'unfitness for work' - this is completely different from what any normal person would be able to expect from his employer, who would be free to sack him if he were sick/injured and unable to carry out his job in the reasonable future. The same applies if a player is crap - you and I would simply be sacked if our performance in our job was unsatisfactory - the standard contract for a professional footballer does not allow this.

The difference with the 'eating too many crisps' scenario is that, if proveable, the matter could be regarded as gross misconduct - and gross misconduct is a sacking-offence, even for a footballer!

I was misunderstood. I didnt mean paying his wages off and sacking him. I meant keep him on contract pay his monthly salary but dont pay for his treatment and leave the choice to him, this way we free up the physio staff and save money on medical costs, but is this legal or will he have something in his contract stating we should make sure he is treated?

Surely as LCFC is his employer they have an obligation to provide him with treatment to get fit or he could be suing the club for negligence! I don't really think that is an option somehow. There must be something we don't know about.

If he has to retire from football then so be it and the club will pay his contract up accordingly. I just can't see him being able to sustain his fitness long enough to earn a move away from the club.
