He would have been set a bail amount I would imagine and paid it. If a "normal" person could pay the bail they would have been released.

Or is that how it works in the US and not in the UK?


It's not normal in the UK for bailees to have to pay money into court but they might be required to do so in certain circumstances.

He's not been charged with manslaughter - and if he had been the maximum sentence is life, not 6 years. As it is, he has been charged with causing death by dangerous driving - and the maximum sentence for that is 14 years, although 6 months to 2 years seems to be what people get. It's also compulsory to ban from driving for at least 2 years; not sure what the maximum is.


There's a whole list of things which are said to make the offence more serious and point towards a longer sentence than the two years. If what has been written in the media is true, several of them would apply here, namely:
  • more than one person killed
  • other person seriously injured
  • uninsured driver/vehicle
  • driver over the drink-drive limit
They only have to find that he was talking on a mobile phone at the time and he could be away for years. :icon_wink

I suspect that many won't be satisfied with the length of the sentence even though it is significantly longer than for most convicted of the offence. And with the sentence being longer, I would anticipate an appeal - and more heartache for those invloved.
 
Just read the report on this. I see that 3 of the 4 points which I said might lead to a longer sentence applied. He had also told witnesses that he had fallen asleep and others had testified that they had seen him earlier driving like a madman. In the circumstances the 7 and a bit year sentence seems to have been the least he could have expected.

He's 25. If he behaves inside and gets full remission he'll probably still be able to resume his career as goal keepers tend to last longer than outfield players.

Yes, he has to live with his guilt, but what he did that night was completely unforgivable.

And more to the point, the people who allowed him to leave in that state, indeed letting him borrow a car should be held accountable.

Their doing nothing contributed to the tragic events that happened.

So you two would and are responsible for every person attending any party you ever hold? When my wedding comes around I don't want to have the weight of other peoples lives resting on my shoulders because others can't make correct decisions on their own actions.
 
Do the right thing and book them some transport pick up/home :icon_bigg :icon_wink

In all seriousness though why should I be responsible for everyone, I have over a hundred people there, I can't monitor every persons intake and whether they are driving. It was a tragic accident and he should and has been punished, but the others at the party are not to blame.
 
I think it was a fair outcome.

On another note, I do think the whole justice system needs to be re-looked at. McCormick killed someone and got 7 years. That canoeist bloke who pretended he was dead, and his wife, both got a similar period. What they did was wrong, yes, but IMO nowhere near to the extent of McCormick.

Financial crimes against the state are the worst crime of all. Mustn't take money away from her maj.
